Privacy Policy & Terms

The short version

Moment keeps your focus to yourself. The sessions, intentions, and reflections you create stay on your device, and if you turn on iCloud they sync privately through your own Apple account. Your insights are written right there on your device by Apple Intelligence. There are no accounts, no tracking, and no third-party services along for the ride.

The one thing we ever see is feedback you offer. If you tell us whether an insight was helpful, the app passes along a small, anonymous note: just the rating, and which version of the insights made it, so we can make them better over time. It leaves out the insight itself, and anything that points back to you.

The rest of this page is the detail, in plain terms, followed by our terms of service. If anything here is unclear, email hi@lumi.studio and a person will answer.

Who we are

Moment is made by Luminous Design Ltd, trading as Lumi, a company registered in Scotland at 13-15 Morningside Drive, Edinburgh EH10 5LZ. For anything in this policy, we are the data controller, and you can reach us at hi@lumi.studio.

What we do not collect

To be specific, the Moment app does not:

  • require an account, email address, or sign-in to use;
  • include any analytics, advertising, attribution, or crash-reporting software from us or any third party;
  • send your sessions, intentions, reflections, or health information to us or to any server we control;
  • build a profile of you, or sell or share personal information with anyone.

The data you create, and where it lives

When you use Moment, you create things like focus sessions, durations, intentions, and how a session felt. This stays on your device. If you enable iCloud on your device, this data syncs across your own Apple devices using Apple’s iCloud (CloudKit) in a private database tied to your Apple Account. It travels between your devices and Apple’s servers, governed by Apple’s Privacy Policy. We cannot access it. To stop syncing, turn off iCloud for Moment in your device settings.

Apple Health

If you grant permission, Moment writes completed sessions to Apple Health as Mindful Minutes, and a session’s feeling as State of Mind. This data is stored by Apple Health on your device under your control. Moment writes it with your permission and does not transmit it anywhere. You can revoke access at any time in the Health app, and you can delete what Moment has written from there.

On-device insights

Moment’s insights are generated on your device using Apple Intelligence and Apple’s on-device Foundation Models. Your data is analysed locally to produce a short observation. The observation itself is never sent to us or to any external service, and generating it works offline. On devices without Apple Intelligence, Moment shows clear summaries computed on the device instead. If you choose to rate an insight, see Feedback on insights below.

Feedback on insights

Each insight has a thumbs up and a thumbs down. This is the one place where Moment sends anything to us, and only when you tap it. When you do, Moment saves a single, anonymous record to the public database of Moment’s iCloud container. That record holds only the rating (up or down), the kind of insight, the app version, and a label for the version of the insight generation that produced it. It does not include the insight text, your sessions, or anything that identifies you. Apple attaches an opaque, iCloud-scoped identifier that we cannot link to your Apple Account or to you. We use the aggregate counts to see which insights people find helpful, and to improve them over time. Rating an insight is always optional.

Purchases

Purchases and subscriptions are handled entirely by Apple through the App Store and StoreKit. We never see your card details. Apple shares with us only the anonymous, aggregate sales information that every developer receives. To confirm whether you have Moment Pro, the app checks your purchase status with Apple on your device.

Aggregate App Store information

Apple provides all developers with anonymous, aggregated statistics, such as total downloads, and, if you have chosen in your device settings to share crash and usage data with developers, aggregate diagnostics. This information comes from Apple, is not tied to your identity, and we use it only to understand overall usage and fix problems. You control this in Settings under Privacy and Security, Analytics and Improvements.

This website

This website sets no cookies and runs no analytics or tracking. Like most websites, the server may keep standard access logs (such as IP address and browser type) briefly, for security and to keep the site running. If you email us, we receive your message and email address, and we keep it only as long as needed to reply and follow up.

Children

Moment is not directed at children under 13, and we do not knowingly collect personal data from anyone. Because the app collects no personal data, it is safe for all ages.

Your rights

Under UK and EU data protection law (UK GDPR and GDPR) you have rights to access, correct, and erase personal data, among others. Because we do not hold your personal data, there is usually nothing for us to retrieve or delete on your behalf. You stay in full control of your own data: you can delete individual sessions in the app, remove all of it by deleting the app and clearing its iCloud data, and manage anything written to Apple Health in the Health app. If you have emailed us and would like that correspondence deleted, just ask. You also have the right to complain to the UK Information Commissioner’s Office at ico.org.uk.

Changes to this policy

If this policy changes, we will update this page and its date. Material changes will be noted clearly. Continued use of Moment after a change means you accept the updated policy.


Terms

Terms of Service

These terms are an agreement between you and Luminous Design Ltd (“Lumi”, “we”, “us”) for your use of the Moment app and this website. By using Moment, you agree to them. If you do not agree, please do not use the app.

Your licence to use Moment

We grant you a personal, non-exclusive, non-transferable licence to use Moment on Apple devices you own or control, in line with the App Store Terms of Service and Apple’s Licensed Application End User License Agreement, which also apply to your use of the app. You may not copy, modify, reverse engineer, resell, or redistribute the app except as the law allows.

Free features and Moment Pro

The Moment timer is free to use. Moment Pro is an optional upgrade that unlocks additional features and is available as a monthly or yearly subscription, or as a one-time purchase. Features included in Pro may change over time as the app develops.

Subscriptions, billing, and trials

  • Payment is charged to your Apple Account at confirmation of purchase.
  • A subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
  • You manage and cancel subscriptions in your Apple Account settings, not within the app. Refunds are handled by Apple under its terms.

Acceptable use

Please use Moment lawfully and as intended. Do not attempt to disrupt the app, circumvent purchase controls, or use it to harm others or infringe their rights.

Intellectual property

Moment, its name, design, icon, and content are owned by Luminous Design Ltd and protected by law. Our marks may be used in good-faith coverage of the app, unaltered. All other rights are reserved.

No warranty

Moment is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or fit for a particular purpose. Moment is a focus timer and wellbeing aid, and is not medical, psychological, or health advice.

Limitation of liability

To the fullest extent permitted by law, Luminous Design Ltd will not be liable for any indirect, incidental, or consequential loss, or for loss of data, arising from your use of, or inability to use, Moment. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer are not affected.

Apple

Apple is not a party to these terms and is not responsible for Moment or its content. Apple has no obligation to provide support for the app. Where you obtained the app through the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of Scotland, and disputes are subject to the courts of Scotland, without affecting any mandatory consumer protections available to you where you live.

Changes

We may update these terms as Moment evolves. We will post changes here with an updated date. Continued use after a change means you accept the updated terms.
